  • Borrowing and Lending #02 MONEY MATTERS Borrowing and Lending #02 Q: An urgent need arose just after lending a cousin $1000. Can I demand the money back before he uses it? When is he required to repay? A: When you lend someone money, it becomes his immediately, even before spending it. (Rashi, Kiddushin 47a) Therefore, you are not entitled to demand the money back right away (although you may ask the borrower to be considerate). If a date was set for repayment, the loan is due that day. If the lender stipulated that he can demand the money back at any time, he may do so even on the day of the loan. (CM 73:1-2) If the agreement was to repay "when able to," beis din should evaluate the borrower's financial circumstances. (Pischei Teshuva 73:4) If no time was set, Chazal established the default time for a loan as 30 days, unless there is an established practice otherwise. (73:1; Magen Avraham 307:14) Some authorities write that although the lender cannot demand the money back until after 30 days, if the borrower can repay earlier and does not need the money any longer, he should do so. (Pischei Choshen, Halva'a 3:5) Generally , the borrower may repay before the due date, even if inconvenient for the lender, unless there is clear concern of a loss due to taxes, imminent currency devaluation, etc. (74:2)
